When you’ve been arrested for a DWI (Driving While Impaired) in the Twin Cities or anywhere in Minnesota and you will need an experienced DWI attorney in Minnesota.

Do not be lulled into thinking that a first time DWI is not a serious crime. There are over 45,000 DWI arrests in Minnesota every year. Judges and prosecutors take DWIs very seriously and they listen to groups like MADD when sentencing a DWI offender. Judges will not show you any sympathy just because you say: “it’s my first offense”. Prosecutors are asking for jail time, even for first time offenders and if you were speeding, involved in an accident, had a high blood-alcohol reading, judges are putting first time offenders in jail.

It is important that your rights are protected under the DUI/DWI law in Minnesota and that you are treated fairly.

The Difference Between Driving While Impaired and Over .08

Driving While Impaired does not require a specific blood alcohol level. All a prosecutor has to prove is that the office observed some indication that driver was driving while impaired after the consumption alcohol or some other chemical.

Over .08 stands for “driving with a blood alcohol content of .08 or more. Notice that there is no mention of impairment. The mere presence of alcohol resulting in test result of .08 or more is a crime and triggers the automatic loss of your driving privileges and may result in the forfeiture of your car, and impoundment of your plates.

Minnesota Driving While Impaired/ Over. 08 Penalties

Loss of Driving Privileges: Usually the first penalty you will feel is the loss of your driving privileges. Other penalties can include the impoundment (destruction) of your plates and possible forfeiture of your automobile. The State of Minnesota can and will take away your driving privileges within seven days of your arrest even before you have had a hearing or stepped inside a courtroom.

What is worse, if you do not take immediate action by filing a Petition for Judicial Determination (look at the back of your seven day temporary license) within thirty days of your revocation the DWI will appear on your driving record and you will lose your privilege to drive for at least 90 days.

Do not confuse your court date with the loss of driving privileges. Your criminal court date has NOTHING to do with the loss of your driver’s license, forfeiture of your car or destruction of your plates.

YOU HAVE RIGHTS! BUT YOU HAVE TO ACT FAST.

The first step in fighting a DWI or obtaining the best possible outcome is to retain an attorney with may years of DWI defense experience! Martin S. Azarian, P.A. has been practicing DWI defense for 22 years. You have important rights, but you must act fast. Remember, your temporary driver’s license is good for only seven days. Wait too long and you will lose your ability to drive a car. Also, you have only thirty days to challenge a DWI. Wait too long and the DWI will appear on your driving record. Don’t wait to go to court, it will be too late.

CAN I GET MY FULL DRIVER’S LICENSE and PLATES REINSTATED?

Yes, in some counties you can have your driver’s license and plates reinstated almost immediately. But you have to call Martin S. Azarian, P.A. immediately. Martin S. Azarian can have your FULL driving privileges reinstated almost immediately.

As for the criminal penalties a first time DWI offender is looking at:

·	$1,000 fine and/or 90 days in jail for a 4th Degree DWI with no aggravating factors.

Criminal penalties for second DWI within ten years of the first DWI are:

·	Minimum 30-day sentence, minimum $900.00 fine. Maximum $3,000 fine, maximum jail sentence is one year.

Criminal penalties for a third DWI within ten years are:

There is a lot at stake when dealing with a DWI charge. As a matter of fact, the consequences can have an incredible influence on your future and that is not a good influence. Whether you’ve been charged with DWI when driving a car, a truck, a motorcycle, a snowmobile (SWI), or a boat (BWI), your future may never be the same.

In order to make sure you get the best possible outcome, you need an aggressive, compassionate, and experienced attorney by your side. You need to be guided through the criminal justice system and not forced through it. The Law Firm of Martin S. Azarian provides 21 years of experience that will work for you in order to have the charges reduced or completely dismissed.

Drunk Driving Lawyer Mendota Heights

There are many consequences of DWI. Not only can you receive a jail sentence of at least 90 days but as long as 7 years, but you can face fines that range from $1,000 to $14,000. There are also other penalties that include:

License revocation, suspension, or cancellation

License plate impoundment

Vehicle forfeiture

Electronic alcohol monitoring

The penalties vary based on the degree of the crime you are charged for. There are four degrees with First Degree DWI being the most severe and Fourth Degree being the least severe as it is considered a misdemeanor.

There are also personal consequences that consist of your reputation being damaged, your auto insurance premiums being raised, loss of your job, difficulty finding a job in the future, and even problems finding a new place to rent when background checks are done.

MN Implied Consent Law

When you obtain your Minnesota Driver’s License, you are implying that you consent to field sobriety testing if it is asked of you upon suspicion of DWI. However, it is your right to refuse field sobriety testing, whether it is a breathalyzer, walking a straight line, standing on one leg, or another type of testing that is asked of you. But when you refuse this testing, you can lose your license and will have to take a blood or urine test later anyway in order to establish whether you do have a blood alcohol content over the legal level. Believe it or not, even those who have not been drinking will refuse a test and will still lose their license.

Before you ever refuse field sobriety testing, make sure you consult with your attorney first in order to know what you should or should not do in this case. You do not have to submit to anything without legal counsel because that is your right, but you must do so within a reasonable amount of time.

Drunk Driving Lawyer Mendota Heights

When you find yourself faced with a DWI charge and you’re not sure what your next move needs to be, call the Law Firm of Martin S. Azarian at 952-975-0663 for your free initial telephone consultation. You could have your charges completely dismissed or have your penalties reduced so that you can move on with your life. That is what 21 years of experience in the Minnesota legal system can do for you.

Have you been accused of DWI? If you have, you are probably very nervous and scared. These are the typical reactions because of the consequences that DWI can have. But know that in Minnesota there are also such offenses as SWI, which is Snowmobiling while Intoxicated and BWI, which is Boating while Intoxicated. You can also be charged with DWI if you are driving an ATV, motorcycle, or any kind of truck.

No matter the type of intoxication charge you have been charged with, you need to have a reliable attorney on your side. The Law Firm of Martin S. Azarian brings 21 years of experience to your case so that you can have the best outcome. It is important to have an attorney who knows the law, but also knows the type of emotional turmoil that a DWI charge can bring.

Drunk Driving Attorney Minnetonka

The consequences are based on a number of factors that are presented to a judge and these factors need to be rebutted by your attorney or holes in the case exposed. Here are the standard penalties that are handed down. However, they can be worsened if the arresting officer finds other crimes being committed at the time of the offense:

A Fourth Degree DWI has no aggravating factors has a penalty of up to 90 days in jail and/or a fine of $1,000.

AThird Degree DWI with one aggravating factor present has a penalty of up to 1 year in jail and/or a fine of up to $3,000.

A Second Degree DWI with two aggravating factors present also has a penalty of up to 1 year in jail and/or a fine up to $3,000.

A First Degree DWI can have up to three aggravating factors present and have a penalty of up to seven years in prison and/or a fine of up to $14,000.

But what are these aggravating factors being talked about? What role do they really play in the prosecution securing a conviction?

A qualified impaired driving incident within the 10 years preceding the current incident. This can include SWI, BWI, driving an ATV, motorcycle, or truck while under the influence of alcohol.

Having an alcohol concentration in excess of .20 at the time of the incident or within two hours following.

Having a child under the age of 16 in the vehicle or more than 36 months younger than the driver.

A conviction could also result in:

License revocation, suspension, or cancellation

License plate impoundment

Vehicle forfeiture

Electronic alcohol monitoring

And if you refuse to take a field sobriety test at the time you are pulled over, you can lose your license anyway and still have to submit to blood or urine tests later. Although it is your right to refuse such tests, under “implied consent” you gave permission for such tests to be conducted when you obtained your Minnesota driver’s license.

DUI Lawyer Minnetonka

Make sure you have a MN DWI attorney by your side as soon as possible. When you do, you will have a stronger case and your attorney will have the time needed to plan a strategy, implement that strategy, and secure the best possible outcome for you. Call the Law Firm of Martin S. Azarian at 952-975-0663 for your free initial telephone consultation. When you have the right attorney by your side, you can have a more productive future.

Being charged with DWI can be a very difficult experience for you or for a loved one. After the charge there are court appearances and possible fines and jail time. But having the right representation from a DWI lawyer who does have experience with Minnesota laws and the courts can make a considerable difference in your case.

There are four different categories of drunk driving crimes:

First Degree Felony DWI

Second Degree Gross Misdemeanor DWI

Third Degree Misdemeanor DWI

Fourth Degree Misdemeanor DWI

Which category your charge falls depends on several factors. First, the number of prior offenses you’ve had within the previous 10 years comes into play. Second, the charge can be more serious if there are any aggravating factors present. It does not matter if the offense is your first or your third, a certain number of aggravating factors can lead to a felony when the offense would otherwise be a misdemeanor.

DWI Aggravating Factors

Aggravating factors include:

A qualified impaired driving incident within the 10 years preceding the current incident. This can include Snowmobiling while Intoxicated (SWI), Boating while Intoxicated (BWI) or another such offense.

Having an alcohol concentration in excess of .20 at the time of the incident or within two hours following.

Having a child under the age of 16 in the vehicle or more than 36 months younger than the driver.

Field sobriety testing may also be conducted to determine intoxication. This can include such acts as walking a straight line, taking a breathalyzer test, standing on one foot, saying the alphabet backwards, and any other test requested. You do have the right to refuse testing, but when you acquire your Minnesota driver’s license, you are basically giving permission for field sobriety tests to be conducted if you are suspected of DWI. If you refuse, you can lose that license and a judge can also use that refusal to make the charge against you even more severe. You will eventually have to submit to urine or blood testing.

Drunk Driving Penalties

As it stands, the penalties can range from hefty fines, jail time, license suspension or total revocation of your license, and alcohol education courses. Jail time can be as long as three years and fines as low as $1,000 or as high as $14,000. That is if there are not a variety of other offenses to accompany the original DWI offense. Sometimes there can be a variety of charges surrounding the same offense, which can worsen the penalties.

It is quite possible to have part, if not all, of the charges dismissed or the penalties reduced with the right help. Call the Law Firm of Martin S.

DWI/Over .08 First Offense

·	Minimum 90-day sentence, minimum $900.00 fine. Maximum $3,000 fine, maximum jail sentence is one year.

Criminal penalties for a fourth DWI within ten years are:

·	Minimum 36 months, $14,000 fine and/or up to 7 years in prison for a 1st Degree DWI.

You want an experienced attorney who is familiar with the state’s laws and has experience with virtually every type of alcohol-related case. This applies to those that are first time offenders and those who have several offenses under their belt.

Drunk Driving Penalties

The DWI penalties come in four degrees with First Degree DWI being the most severe of the offenses and carrying the highest penalties. You can also receive defense in the following areas:

Misdemeanor, gross misdemeanor, and Felony DWI

Driver’s License Revocation, Suspension, Cancellation, or B-Card License issues

Boating while Intoxicated (BWI), Snowmobiling while Intoxicated (BWI), and intoxication while driving any other vehicle including ATVs and motorcycles

Underage possession and consumption

Motor vehicle forfeiture and license plate impoundment

You will be provided with full representation that will present evidence on your behalf that will dismiss or reduce the charges. You can also receive probation violation representation and assistance with any appeals so that you can have your original charges and penalties eliminated or reduced.

Field Sobriety Test Refusal

If you are pulled over for DWI and you refuse to take sobriety tests, there are penalties. It is your right to refuse these tests, but you will ultimately be given a urine or blood test anyway. Test refusal can lead to revocation of your license because when you acquire a Minnesota driver’s license, you are basically giving the state permission to perform sobriety tests if they are requested of you. This is called “implied consent,” which is why you can lose your license.

Before you refuse a test, make sure you consult with an attorney first because you need to know the consequences and what your next move needs to be so that you can make the best one.
